Boat & Watercraft Owner Responsibilities

Everyone who owns or operates a boat has a duty to adhere to common sense rules to ensure the safety of our waterways. This duty extends to the ownership and operation of every type of watercraft, including power boats, jet skis, sail boats and even smaller vessels, such as kayaks or canoes.

Failure to use care when operating, consistently inspecting and maintaining any type of watercraft may result in serious personal injury or death. The owner or operator may then be held responsible and financially liable to the injured party.

The basic responsibilities of a boat or recreational watercraft owner include:

  • Regular inspection and maintenance of all boats or watercraft to ensure it is in proper or safe condition
  • Knowledge of the basic rules of safe boat handling and operation
  • Maintaining all necessary safety equipment in operational conditionon board the watercraft
  • Maintaining an adequate number of U.S. Coast Guard approved life vests or personal flotation devices - and insisting that they be used!
  • Careful operation of the boat or watercraft according to all boating rules and regulations
  • Do not operate any boat or watercraft while under the influence of alcohol or recreational drugs
  • Instruct guests as to the basic rules of boating safety, and insist that basic safety rules are followed by everyone on board
  • Operate and navigate the boat only in safe waters and in safe weather or sea conditions
  • Always have a non-driver "observer" whenever towing water skiers
  • Avoid dangerous operation or "showboating," avoid excessive speed and maneuvers beyond the skill of the operator or water skier
  • Use great caution in all boating activities in which children are involved
