Kershaw, Cutter & Ratinoff Seeks Lead Position in DePuy Pinnacle Hip Replacement Litigation
Attorneys with experience litigating against Johnson & Johnson Corporation argue for the lead in ongoing DePuy Orthopedics hip replacement litigation proceedings.
July 26, 2011
On August 9, attorneys from Kershaw, Cutter, and Ratinoff will file a motion in Federal Court to be considered for lead counsel in the nationwide litigation against DePuy and Johnson & Johnson arising from numerous complaints from hip replacement patients implanted with the DePuy Pinnacle metal-on-metal hip device. Kershaw, Cutter & Ratinoff, which represents hundreds of individuals with recalled DePuy ASR and Pinnacle hips and serves on the Executive Committee for ASR cases in California, argued that that it has the knowledge and experience to adequately take the lead in this litigation.
The national class action law firm has previously been appointed lead counsel in many nationwide class actions and mass torts and has recovered hundreds of millions of dollars for its clients. At the hearing, their attorneys stressed their years of experience litigating mass tort cases against Johnson & Johnson and its subsidiaries.
"Over the past eight years I and my partners have been involved in a constant state of litigation against Johnson & Johnson. These include cases arising from the recalls of Vicryl Sutures, Panacryl Sutures, and Intergel. All of these cases were heavily litigated and resulted in settlements shortly before trial. Hence we have a unique appreciation of how Johnson & Johnson does business and really know where all the bones are buried," argued medical device attorney and KCR partner Stuart Talley.
A decision from the judge is expected shortly.
